Judge: No immediate restraining order against Avenatti

"U.S. District Judge James Otero said Cohen had not shown he would suffer "immediate, irreparable injury" absent emergency relief against Daniels' lawyer, Michael Avenatti", Reuters reports.

In their court filing Friday, prosecutors said they had reconstructed about 16 pages of shredded documents that had been found inside a shredder during the raid. Cohen has until June 25 to review the materials and make any claims of attorney-client privilege; after that, any messages he claims are protected will be reviewed by the Special Master, retired federal judge Barbara Jones.

The probe has taken a toll on Cohen, who has expressed worries about the financial burden of mounting a legal defense against federal prosecutors with extensive resources, according to a friend who spoke with Cohen in the past few days.

Avenatti has "repeatedly denigrated Mr. Cohen, predicted that Mr. Cohen would be indicted for bank fraud, wire fraud, campaign finance violations, and accused Mr. Cohen of hiring a "thug" to allegedly threaten Ms. Clifford", the filing said.

Cohen bolstered his claim by citing U.S. District Judge Kimba Wood in NY, who is presiding over Cohen's request for a review of materials seized in the Federal Bureau of Investigation raid. Cohen has admitted making the payment, but Trump has denied the encounter with Daniels.

Daniels and her attorney Michael Avenatti have alleged that the payment, made shortly before the November 2016 presidential election, was hush money to keep her from publicly talking about a sexual tryst she had with Trump in 2006.

Otero did not decide whether a restraining order should eventually be granted.

The deadline extension comes as Cohen, under severe financial pressure, has chose to split with his current team and hire new lawyers, according to a person familiar with the case.

The case is Clifford v Trump et al, U.S. District Court, Central District of California, No. 18-02217.
