Governor asks for federal investigation into ICE conduct

The Republican, who represents the district around the base, told WNYC: "Liberal activists are attacking ICE agents and military personnel for following the law in detaining an immigrant reportedly here illegally".

A federal judge has given a last-minute reprieve to a New York City restaurant worker who was fast-tracked for deportation this month, after he showed up at an Army base with a delivery of pasta and the wrong type of ID.

The married father of two, will remain in ICE custody until his case goes to court.

"They look different today and I'm happy for that", Sandra Chica, Villavicencio's wife, told the New York Daily News of her children on Sunday.

Lawyers from the Legal Aid Society of NY filed a petition with the NY field office of ICE on Friday to have him released on humanitarian reasons as he is the primary provider for his wife and two children, all of whom are USA citizens.

After the hearing, her attorney , Jose Baez , told TMZ , "Rose steadfastly maintains her innocence". However, he wrote to the Virginia court in November that the drugs had time to be planted.

But "there was a different security guard", Villavicencio said, and an official began to question him - first asking for a driver's license, then a Social Security card, then calling police to ask about his background and discovering the old ICE warrant.

"This is unhuman", Chica said during a phone interview. - He did not commit any crimes, he is the father who works for his daughters. "Every day our daughters ask me why their dad is not coming home".

Judge Nathan's order says the government must keep Villavicencio within the New York City area. Democrat Cuomo also promised to give the family a free lawyer.

"Sandra spoke to me as a mother of their two daughters - anxious for her husband and her children", he said in a statement.

Gregory Copeland, supervising attorney of the Immigration Law Unit at The Legal Aid Society, said the stay is a victory for Villavicencio, his family and for "due process and the fair administration of justice".

Natalia Aristizabal of Make the Road New York called Villavicencio "a man who wants nothing more than to stay with his wife and daughters". The check revealed an active ICE warrant on file, Fort Hamilton said. Brooklyn City Councilman Justin Brannan said.

At a press conference in Federal Plaza, Villavicencio's attorneys and supporters called on ICE to recognize the stay, and urged Governor Andrew Cuomo to take further action to protect New York's immigrant community. As a result, his voluntary departure order became a final order of removal, Immigration and Customs Enforcement said.

A statement issued by Fort Hamilton last Friday said Villavicencio attempted to make a delivery about 11 a.m. but lacked identification required to enter.

"What prompted them to call ICE?" she asked. "They don't care about the impact this will have on us".
