It was revealed that the driver in the March 23 crash, who was killed when the auto slammed into a highway barrier, was not acting according to its recommendations when the accident occurred.

Despite the troubles around the ramp-up of its Model 3 production, Tesla is already eyeing the launch of its next model, the Y, in November next year, two unnamed sources told Reuters.

"If necessary for public safety, and with the IIC's permission, party coordinators may release information to their respective organizations provided the information is factual, neutral and objective in tone, and without purported NTSB characterization of the matter's contribution to the underlying accident", the agreement says. The agency is investigating the crash of a Model X that was running with Autopilot engaged when it slammed into a highway divider in Northern California last month, killing the driver.

"Just because a driver does something stupid doesn't mean they - or others who are truly blameless - should be condemned to an otherwise preventable death", said Bryant Walker Smith, a professor at the University of South Carolina's School of Law, who studies driverless-car regulations. "Participation in the party system is a privilege, which allows the sharing of investigative information with all parties that agree to the terms of the party agreement during the early fact-gathering phase of an investigation", the NTSB said. "The characterization of the call as relayed to Bloomberg is false", a Tesla spokesman said in an emailed statement.

In a March 30 blog post, Tesla said that the Model X driver's hands weren't on the steering wheel for six seconds prior to the fatal crash. The NTSB guards the integrity of its investigations closely, demanding that participants adhere to rules about what information they can release and their expected cooperation.

The company talked about its "preliminary overview" elements to Tesla as being at fault over the lethal crash. Tesla said it had made improvements in the system since the crash.

The rapid about-face on Tesla's stance towards the NTSB is the really interesting thing here, however.

Tesla said Thursday it will no longer participate in a USA probe of a fatal crash after disagreeing with officials over public disclosures about the investigation.

"If you are driving a Tesla equipped with Autopilot hardware, you are 3.7 times less likely to be involved in a fatal accident and this continues to improve", the spokesperson said.

Musk has previously griped about the NTSB's involvement, saying it's up to the National Highway Traffic Safety Administration (NHTSA), not the NTSB, to regulate the auto industry.
