District Court: Massachusetts 'Assault Weapons' Ban Is Constitutional

Massachusetts' beefed-up ban on assault weapons doesn't violate the Second Amendment of the Constitution, a us judge ruled, handing a victory to gun-control advocates seeking to pass such a law nationwide following a spate of deadly mass shootings.

Over the past decade, four court decisions have upheld assault-weapon bans. On Thursday morning the Illinois State Rifle Association announced that they and the Second Amendment Foundation had jointly filed a lawsuit against the Village of Deerfield.

Gun litigation has taken on a new urgency following the February 14 shooting at a high school in Parkland, Florida, where 17 people were left dead.

This notion was ruled out, however, as the judge remarked the the layout of semi ar15's is centered on guns "that were initially fabricated for military reasons" and that the AR-15 is "common and well-known at the military". "Families across the country should take heart in this victory", she said.

The featherweight champion was looking to join McGregor as the only fighters to hold two belts in the UFC at the same time. Since Romero and Pettis both missed weight in their title fights they were not able to win the title.

"The AR-15's present day popularity is not constitutionally material", Young said.

In addition to the Parkland shooting, the ordinance noted other recent mass shootings with fatalities in the double digits: the Sutherland Springs, Texas, church shooting that killed 26 people, the Las Vegas music festival shooting that killed 58 people and the Pulse nightclub shooting in Orlando that killed 49 people.

"These are weapons of war that belong on the battlefield, and we were pleased today to see yet another court agree with that stance", Kris Brown, co-president of the Brady Campaign to Prevent Gun Violence, said in a statement. She said at the time that gun manufacturers were circumventing Massachusetts' ban by selling copycat versions of the weapons they claimed complied with the law.

"Every law-abiding villager of Deerfield has the right to protect themselves, their homes, and their loved ones with the firearm that best suits their needs", Chris W. Cox, executive director of the NRA's lobbying arm, said in a statement.

Jim Wallace, executive director of the MA gun owners group, said Young's upholding of Healey's crackdown on copycat assault weapons gives the attorney general "unbridled authority" to interpret laws as she pleases.

Owners of assault weapons living in north suburban Deerfield have until June 13 to remove the firearms from within village limits or face daily fines after a ban was approved Monday night.

"Everyone in the state should be really concerned about that", Wallace said. The 7th U.S. Circuit Court of Appeals held that legislation constitutional and the U.S. Supreme Court let the decision stand when it declined to take up the appeal.
