Cancer patient wins $30 million in lawsuit against Johnson & Johnson

The verdict of liability in Middlesex County Superior Court in New Brunswick came as J&J fights thousands of cases claiming its talc products can also cause ovarian cancer.

Talcum powder is made from talc, a soft mineral found in deposits often located near asbestos deposits. Studies have shown there is a risk of cross-contamination during mining.

Exposure to asbestos fibers has been linked to mesothelioma, an aggressive cancer that develops in the lining of the lungs, abdomen or heart.

In addition, Lanzo's attorneys presented testimony from William Longo, an electron microscopist and expert in materials science, who testified that he found asbestos in more than half of the 32 samples of Johnson & Johnson talcum powder products that he tested.

In August, an Alabama woman who claimed the products gave her ovarian cancer was awarded $72 million.

J&J won the first case to go trial over mesothelioma claims tied to its baby powder when a California jury ruled in November that the product wasn't responsible for causing a 61-year-old woman's cancer.

In five trials in Missouri, juries found the company liable four times and awarded the plaintiffs a total of $307 million. "JOHNSON'S Baby Powder products contain only U.S. Pharmacopeia (USP) grade talc, which meets the highest quality, purity and compliance standards", a statement on the company's website reads.

One of Lanzo's lawyers, Moshe Maimon of Levy Konigsberg in NY, told the jury in his closing argument of a 1969 company memo that was introduced into evidence.

A key piece of evidence for the prosecution was an internal memo from 1969 in which a scientist specifically mentioned asbestos contamination in the company's talc.

Johnson & Johnson said its talc products do not contain asbestos, which, it noted, has been a legal requirement since the 1970s. A seven-woman jury in Middlesex County found both J&J and Imerys concealed the asbestos in their products, which files from Lanzo's legal team indicate they may have anxious about as early as 1969, per Bloomberg. It found J&J was responsible for 70 percent of the damages and said a unit of France-based Imerys SA (IMTP.PA), its talc supplier, was responsible for 30 percent.

Under New Jersey law, jurors had to assess how much responsibility J&J and Imerys bore for Lanzo's injuries.
