A senior Malacanang Palace official defended the inclusion of a United Nations rapporteur, a Filipino citizen, in the list of 600 alleged communist leaders and members whom the government wanted to be declared as "terrorists" by the court.

But Roque has also said the ICC has no jurisdiction over the case because the tribunal was intended as a "court of last resort" and the Philippine courts were fully functioning. He stopped doing this just a few months later after he said he was being repeatedly attacked by the New People's Army, claiming in its petition to the court that they are "using acts of terror to sow fear and panic to overthrow the government".

The Government petition included Victoria Tauli-Corpuz, appointed in 2014 as United Nations special rapporteur on the rights of indigenous peoples, who was listed as a senior member of the Maoist rebel group.

"There's a long history in the Philippines of the state security forces and pro-government militias assassinating people labelled as NPA members or supporters", he said in a statement.

Ms Tauli-Corpuz denounced the Government, calling the complaint "baseless, malicious and irresponsible".
