Kenya Supreme Court nixed poll because it couldn't see data

Mr Kenyatta said he had chosen to respect the Supreme Court ruling that nullified his August 8 election victory and opted to return to the ballot.

Kenya's new election has been delayed to October 26, the polls commission said Thursday, as it seeks more time to fix issues that led to the initial vote being annulled.

"What happened in our country is nothing short of what Kenya has so successfully avoided over the past 53 years of our independence, and what has happened in many other African countries where we have seen coups by the army coming to overthrow the government", Kenyatta said in a televised address.

Kenyatta spoke to supporters Thursday, a day after the Supreme Court gave its detailed judgment on why it invalidated the August presidential poll.

On concerns that there would be increased violence and protests if he lost the fresh elections, Odinga stated, "If I lose elections fairly, I will accept and tell my supporters we lost fairly".

Kenya's Chief Justice David Maraga said Tuesday that since the September 1 judgment nullifying the election results, there have been attempts to intimidate judges. "The [board] can not, therefore, be said to have verified the results", she noted.

Not only was the IEBC process "neither transparent or verifiable", but it "contemptuously ignored the court order" to allow scrutiny of its computer servers, in the words of the Supreme Court judgement.

Odinga also lost the 2013 presidential elections to Kenyatta.

"This suspension is necessary to not just restore the waning public confidence in the commission's ability to prepare and deliver credible polls but also assert the integrity and fidelity of the commission to the rule of law", Chebukati said in a leaked internal memo.

Deputy Chief Justice Philomena Mwilu said the forms should have been quickly available for inspection, noting officials had said that thousands of forms from polling stations were still unavailable four days after the official results were announced.

Mr Odinga has demanded reforms in the electoral commission before the election takes place, including the removal of top electoral commission officials he claims were involved in electoral fraud.

Tuju's comments came after Odinga's vow to boycott the new presidential elections, scheduled for October 17, if there was no reform of the country's electoral commission prior to the scheduled date.

Kenyatta was named the victor of the August 8 election, officially winning 54 percent of the vote.

Meanwhile, chaos broke outside Supreme Court in Nairobi when police used tear gas canisters to disperse the protesters that had blocked the entrance for some hours.
